Avery's parents were Robert Franklin Lewis, born in Texas, and Frankie Holloway, born in Alabama, Texas, or North Carolina (varied with census year reports). He was listed as Robert on the 1900 census. His siblings were Beulah, Rudolph, Basil O., and Vernon Bruce. The family lived in Blanco County, Texas, where his father farmed. The family lived in Burnet County, Texas, in 1910. His father and brother Rudolph were farming. There were 3 new siblings, Edna P. "Nellie", Jewel (male) and Elwyn. At the time of the 1920 census, Avery was a farm laborer on the home farm in Burnet County along with his father and brothers Rudolph and Bruce. There was a new sister, Roberta. His second wife was Bonnie Zanobia Smithson. Their children were Jerry Lynn, Martha Edna, and John Avery.

Avery married Stella Krause, daughter of Carl Gulf Krause and Celia Elizabeth McInnish. (Stella Krause was born on 16 May 1903 in , Burnet County, Texas,^{5 7} died on 4 Jan 1928 in Spicewood, Burnet County, Texas ^{5 7} and was buried in Holloway Cemetery, Burnet County, Texas ^{7 8}.). The cause of her death was pericarditis, premature confinement.

Avery next married Bonnie. (Bonnie was born on 13 Jun 1913, died on 7 Nov 1969 and was buried in Holloway Cemetery, Burnet County, Texas.)
